NEW, CALIFORNIA HEALTH INSURANCE COVERAGE REQUIREMENT

As of January 1, 2020, Californians must have qualifying health insurance coverage for themselves, their spouse or domestic partner, and their dependents for each month.

  • Those who fail to maintain the coverage could face a financial penalty unless they qualify for an exemption.

ACA UPDATE

Dear OCESD Employees:

The Affordable Care Act has changed the way we all view health insurance; what once was a luxury is now considered mandatory by Federal Government. There are OCESD employees who have not been eligible for health insurance in the past, but are eligible now.

This being said, if you were not otherwise eligible for health insurance through OCESD, you are now being given the opportunity to participate in the “Oak” health insurance plan. To be eligible to participate for one year, an employee must:

- work 30 or more hours in any given week or;

- work 130 or more hours in any given month.

The Federal Government also requires you accept or decline this insurance coverage for every month you meet the eligibility requirements. To make this as simple as possible, the official form is now printed on the back of employee time cards. Simply put, if you work more than 30 hours in a week or 130 hours on a time card (or combination of part-time regular work and time card work), you must flip over your time card and accept or decline coverage.

Q: What if I do not fill out the back side of my time card and I qualify for coverage?

A: Your paycheck could be delayed until you complete the back side.

Q: How do I measure a month?

A: We consider a “month” the time span on your monthly time card.

Q: What if I work a regular job and pick up extra time card hours, would I combine those hours to measure my eligibility?

A: Yes, you would combine all OCESD hours worked for each week and month to determine if you are eligible.

SICK LEAVE FOR ALL

OCESD HEALTHY WORKPLACES/HEALTHY FAMILIES ACT OF 2014 PAID SICK LEAVE POLICY

NOTE: This only applies to employees who would otherwise not be eligible for sick time. These are generally Substitute Employees and Noon/Morning Duty Supervisors who hold no other positions with OCESD.

Entitlement:

  1. An employee who, on or after July 1, 2015, works for 30 or more days within a year from the beginning of employment is entitled to paid sick leave.

  2. Paid sick leave accrues at the rate of one hour per every 30 hours worked, paid at the employee's regular wage rate. Accrual shall begin on the first day of employment or July 1, 2015, whichever is later.

  3. Accrued paid sick leave shall carry over to the following year of employment and is capped at 48 hours.

Usage:

  1. An employee may use accrued paid sick days beginning on the 90th day of employment.

  2. Paid sick time shall be provided upon the oral or written request of an employee for themselves or a family member for the diagnosis, care or treatment of an existing health condition or preventive care, or specified purposes for an employee who is a victim of domestic violence, sexual assault, or stalking.

  3. Employee may only use paid sick time for up to 24 hours in each year of employment.
